Wildturkey, I thought I would report about what you can own not own; What you can manufacture or alter here as there is a lot of questions and maybe miss information out there.
I used this link if you want to read the whole thing. It is a good read:
http://www.recguns.com/Sources/IIF1.htmlIn summary:
> A citizen can not own a post-1986 machine gun or lightening link (Don't know how they would
verify this one)
> If you qualify; your state and your local municipality allows; you can own a machine gun or
devise. You must get written permission from your Chief of Police. There is a $200 tax you pay
the government for the transfer. It is recommended that you keep the original transfer
paperwork in a safe place and have with the machine gun a copy.
Transfer of weapon or devise must be from a FFL that has a Class 3, SOT (Special Occupancy
Taxpayer). Machine guns that meet FFL C&R (Type 3) standards, e.g. a WW II Sten or WW II
BAR, still have to pay the weapon transfer tax but it is easier to obtain as they have gone
through the FFL process.
> Now if you want to make or alter an existing weapon to make it a machine gun or produce a
devise that makes your semi auto fully auto you need to have a class 2 SOT. Cost is $500- a
year IF your revenue is less then $500,000- a year. You do not need to get permission to make
or alter a weapon or devise but need to register it within 24 hrs of completion. If you do not
renew your SOT yearly, you will loose the right to posses the post-'86 weapon or devise.
I haven't looked at the application for the SOT however, I am sure you need to have an actual
business complete with a business license, business address, etc.
So there you go. Easy to acquire and own a pre-'86 machine gun or devise then a post-'86 machine gun or devise. You just have be able to pass the background check, your state allows such ownership of said weapon, your town/ city Chief has to allow it and pay the $200- one time transfer fee. It is a bit tougher to own a post-'86 machine gun or devise.
Thank you Wildturkey for putting up a red flag on this one. I would hate for any SP member to get into any trouble with BATF&E
I forget if it was Reaver or OONW who has expressed in the past that you don't need a fully auto AR or AK. Semi fire is more then adequate.
