Cherokee County, NC - Proclamation of a State of Emergency

Section 1. Pursuant to Chapter 166A of the General Statutes and Article 36A Chapter 14 of the General Statutes, I have determined that a State of Emergency exists within Cherokee County, NC.

Section 2. I, therefore, proclaim the existence of a State of Emergency within Cherokee County, NC.

Section 3. I hereby order all county law enforcement officers and employees and all other emergency management personnel subject to my control to cooperate in the enforcement and implementation of the provisions of the county emergency ordinances which are set forth below.

Section 4. Curfew. Unless a member of the County's law enforcement agency or the emergency management program, every person who is located within:
a) Peachtree Community incorporating Old U.S. 64 to the Cherokee-Clay County Line extending to new U.S. 64 to Hendrix Road and N.C. Hwy 141 from 64 Alt. to Rolling Hill
Road
b) Wehutty Road from Prince Road to Candy Mountain Road
c) Candy Mountain Road from Shoal Creek Road to Liberty Road
d) Texana from Joe Brown Highway to Joe Brown Highway

This does not include travel to and from medical or emergency facilities.

Members of these communities are to be inside a house dwelling from the hours of 6:30 pm to 7:00 am.

These areas are without power and may pose a dangerous environment to homeowners, travelers and community members.

Section 5. No Alcoholic Beverages. There shall be no sale, consumption, transportation, or possession of alcoholic beverages during the State of Emergency within Cherokee County, NC, except possession or consumption is allowed on a person's own premises.

Section 6. No firearms, ammunition, or explosives. During the State of Emergency, there shall be no sale or purchase of any type of firearm or ammunition, or any possession of such items along with any type of explosive off owner's own premises.

Section 7. Execution of Emergency Plan. All civilians and emergency management personnel are ordered to comply with the emergency reaction plan.

Section 8. This proclamation shall become effective immediately. Proclaimed this the 03 day of March 2012 at 12:47 (p.m.)

depends on the situation.  I can understand a curfew if it is in an area completely devastated by disaster and not enough law enforcement to keep looting down...

But martial law?  No alcohol consumption?  No firearms outside your property, even if its usually legal? 

I would probably be sitting OUTSIDE my dwelling after dark with a beer in one hand and a rifle in the other.  Liberty, Fuck yea.

In responce to a tornado? Not an abuse of power dude, just local government trying to keep good order. Now if it was a bright sunny day or an order that never gets lifted.... that would be a different story.

Used to happen all the time after a hurricane when I lived in eastern NC. They are trying to keep the looters down, they had some bad storms up there the other day. The no firearms thing, the cops wont really bother with unless they are just the revenuer type.

This isn't uncommon really. My local township is trying to draft some similar emergency plans this year. Most larger metro areas already have stuff like this in place. Obviously there can be abuses of power, but this definitely isn't the case.

Oh, and OONW, luckily you're not my neighbor. If I saw you staggering around yours or my own front yard at 2:00am drinking, shouting and carrying a gun you'd be praying the cops would come get your ass before I got to my gun safe. I don't care if you are trying to be funny.

Only parts I really have a problem with are section 6 & 7, some thoughts follow.

Regarding section 6,  myself and any neighbor I already have an agreement with will carry our firearms anywhere on our property as well as each others. We fully understand the idea of isolation and the disarming of individuals by law enforcement and the national guard as evidenced in New Orleans after Katrina.

Regarding section 7, I am an American citizen and will not be forced into labor nor involuntary service at the whim of a public servant. Ask and I may help or even volunteer but order me at your own risk.

One part of section 4 gives me some pause as I understand the desire to keep people inside and therefore make law enforcements job easier but some repairs will have to be made as well as maintaining property from further damage.  Limiting the hours one can work on ones property seems arbitrary and for simplification and ease of law enforcement primarily without serious consideration of recovery by individuals.

LOL, didn't mean I'd shoot him. I'd simply advise him as politely as you can advise a drunk to drop his rifle and get on the ground while keeping my eye on his chest. Then there's a reason I have 175lbs zip ties. When he sobered up I'd let him go.

As far as missing  ::) I've been shooting since I was 5 and there's not much I do better innately then hitting my target.  ;)

Actually in my state if a man were in my front yard or his own with a rifle and I felt threatened I could blast him through my windows or doors and not a question would be asked. It's not an arguement. We simply disagree and have different perspectives. As a husband and father I see a drunk with a gun as a threat. And in the event of no law enforcement being available citizens can and should take steps to prevent people from being harmed. I mean how would you, I, or anyone else know that the drunk individual would not start going house to house shooting people or just shooting their homes? Like I said, difference of perspective.

Yeah, they do the same thing here in Florida when a hurricane hits.

You guys up there look out for the nails in the messed up areas.  After the 2004 hurricanes people were getting flat tires all over the place for months afterwards.


I'm good here. It hit a good bit west of here. Only problem we're really having is figuring out wtf happened to our warning system. The dumb ass county (directly north west of us) that has the radar alerted their own county and the one beside us, but never alerted us until after a tornado was spotted on the ground even though the admitted they saw the rotation.  [img]http://www.arrse.co.uk/at

Wow... Some people read way too into shit.

First off, WW, in regards to the warning system.  I just went through NWS Spotter training last night ironically and since there were a few LEO's present that very question was brought up.  Generally when the NWS sees a clear indication of a tornadic event they will, depending on the evidence and such, issue a tornado warning.  It is then up to the city, county, etc. to sound the warning.  For instance, that devastating tornado that ripped through Joplin not too long ago, the sirens were sounded long before the tornado hit because the NWS had issued a warning for the county for a storm cell that was clearly moving north and away from Joplin.  People in Joplin, afterward, reported that because of the frequency of tornado alarms because of this policy that they had become used to and even ignored them.  The NWS has since adopted non-county based warnings so that this will help improve the decision making process of counties and cities of when to sound the alarm.  Also, some people thought on that day that the later sounding of the siren, the one indicative of danger, was an all clear signal.  Obviously this is not the case, so it would be wise for you individually to learn of your local procedures for alarms and whether they issue an all clear or let NWS or emergency radio centers do such.


I understand where you are coming from.  I too am a father and would do what is necessary to protect my daughter.  That said, if we were neighbors I would hope you wouldn't react like that since we would already know each other and hopefully been good friends.  NEVER in my post did I mention getting drunk, and very few people that I know (especially with my heritage! lol) get even phased by one beer.  Never did I even say that I would be drinking it.  NOR do I advocate using friearms while intoxicated. (You would think I was posting on a liberal site to have to put all these disclaimers on here. [img]http://www.arrse.co.uk/at )  I am talking about civil disobedience to an unnecessary and STUPID law, which unfortunately is accepted because of the kind of country we have become.  If we still had groups of able bodied men (and women today) that could patrol the streets to help maintain order and assist in search and rescue that were NOT PART OF some alphabet soup agency but just regular people, then there wouldn't be a need for "martial law" in those kinds of situations, or ever really...
