Lets' remember that martial law was imposed by Andrew Jackson, Abraham Lincoln and Woodrow Wilson. Specifically it was just the suspension of the right of Habeas Corpus. All decelerations of Martial Law were over turned upon reaching the US Supreme Court. It took years to run it's course through the lesser courts till it arrived before them; However the Constitution did hold up.
Now some governors have declared partial martial law in the past to control riots. These declarations of martial law were typically limited to specific regions within the state.
Regardless, any martial law declarations must be signed off on by congress- State or Federal.
