Title: Louisiana Law says No Cash Transactions At Flea Markets And Other Places.

This applies to a 2nd seller who sells used items.  It could apply to flea markets, gun shows, baseball cards, Craigs list, or ebay items.

So Nola, what do you think of this?  I hope it doesn't spread to other states.

Not necessarily, the wording of the law effectively outlaws barter:   "Payment shall be made in the form of check, electronic transfers, or money order issued to the seller of the junk or used or secondhand property..."

Not necessarily, the wording of the law effectively outlaws barter:   "Payment shall be made in the form of check, electronic transfers, or money order issued to the seller of the junk or used or secondhand property..."

'A secondhand dealer shall not enter into any cash transactions in payment for the purchase of junk or used or secondhand property."

as i understand it, its saying if you are barting its outlawing cash as a form of payment. for example "ill trade my corvette for you ferrari plus some cash".. never says in that trade you cant avoid payment all together. i dont think they can say your not aloud to trade this item for that item straight across.

Yeah, it makes the term "this note is legal tender for all debts public and private " sort of meaningless in Louisiana doesn't it?

woah woah.... fuck. aside from the obvious control-grab that this is (making sure you leave a paper-trail everywhere you go), the truly sad part is that NO ONE KNOWS ABOUT THIS.

I like what Boonedawg said. fuck 'em. If I wasn't laughing so hard at this I might be pissed. If the people around here are anything like they seem to be, they'll have the same attitude.
Just another dumb law on the books that won't be enforced, and even if they try to enforce it, that will just encourage even more people to take on the "fuck 'em" attitude.

BTW,  the definition of barter is:  trade without the use of any standard currency, trading item(s) for item(s) only.......It is a common misconception that barter can include cash, and it is often used that way, but technically wrong by definition.
     
But to get back to the conversation at hand....It seems to me, they are giving a specific list of how the trade of "junk and used and second hand" items should be "legally"conducted.  In that list barter is not mentioned.  Therefore not allowed.

going off of this quote as the wording in question id say the key word here is payment. payment i feel would sudgest im giving you something worth nothing as a physical item on its own for your items(s).

if i trade you my gold for your car then we both are getting items of value on there own. so whos recieving the payment in that situation?.. i think neither is so i feel that bartering or trading does not fall under that quotes restrictions. further more trading isnt the sale of anything.. in trading theres no sale being made. instead a trade has been made. thats how im reading it...might be right, might be wrong.

honestly guys, you can sit here and argue about the definitions of terms and the technical meanings of things all day long and it don't make a bit of difference. they do what they want because they can.

this is a bit unnerving because I'm not so used to seeing this type of trash coming from my state. of course, Louisiana has always been an ass backward state, but usually this ultra-intrusive bullshit gets shot down around here.

but like I said before, fuck them. I'll pay for or trade for anything I want, however I want. they can go choke for all I care.

if they actually enforce this, it will suck though. the thrift store is a fucking goldmine, but I'll be forced not to participate if this BS is actually enforced. fuck that. I won't fly because of TSA, and this is no different. the sad thing about this is that if more people would just wake the fuck up, then much more people would have the same attitude as I do. and when the lawmakers start seeing thriftstores and fleamarkets all over the state closing their doors because so many folks refuse to comply with this crap, then they'd see what a dumb mistake they made. but alas, we have just as high of a concentration of morons as anywhere else.

You keep the flea markets open and make sure you can throw whatever "enforcement" assholes out in the goddamn street and let the beating be a warning to the next fuck stick, bureau weenie that bullshit is not tolerated...this is OUR country. Act like goddamn men and stand against this bullshit loudly and unashamed. If you get arrested...demand a jury trial, I for one wouldn't cast a guilty vote in that jury. This is the shit that gets my blood up.
