AFFIDAVIT OF TRUTH

The alleged violation was 28-3473A. This is an infraction of codes/statutes that violate my inalienable rights, which are supposedly protected by the Bill of Rights. This false allegation needs to be dismissed and the arresting officers need to be charged with unlawful detainment/kidnapping. I will be filing charges against these officers for violating my rights.

I was unlawfully detained/kidnapped on March 13th, 2015 by 3 armed people in uniforms, claiming to be Deputies, yet they violated my inalienable rights, which are supposed to be protected by the Bill of Rights.

Traveling has been described as: “The right of the citizen to travel upon the public highways and to transport his property thereon, either by carriage or by automobile, is not a mere privilege which a city may prohibit or permit at will, but a common law right which he has under the right to life, liberty, and the pursuit of happiness.” Thompson v. Smith, 154 SE 579.

I was traveling in a safe manner southbound on Melody Street in Kingman AZ when I was forced to pull over. I had harmed no person or property and was peacefully traveling in my personal conveyance. A man in a uniform, claiming to be a Deputy and used the name MATT GIRALDE, pulled me over. I had harmed no person or property. This individual MATT GIRALDE asked me for ID, even though he already knew me. He had unlawfully detained and kidnapped me on February 24th, 2015. He asked me for a Drivers license, which I am not required to have.

This man, MATT GIRALDE is operating under the color of law and is harassing me personally. He violently and unlawfully detained/kidnapped me on February 24th, 2015 for asserting my inalienable rights. During the February 24th interaction, this man also assaulted me and tried to break and enter into my personal conveyance without cause. I want this stopped immediately. I want a restraining order placed against this Deputy and him removed from the force immediately. This man is clearly psychotic and a danger to the public.

This is clearly a violation of the 4th Amendment.
FOURTH AMENDMENT
“The right of the people to be secure in their persons, houses, PAPERS, and effects, against UNREASONABLE searches and seizures, shall not be violated, and no Warrants shall issue, but upon PROBABLE CAUSE, supported by Oath or affirmation, and particularly DESCRIBING the place to be searched, and the persons or things to be seized.”
The pull over was Unconstitutional and unlawful violating my inalienable right to travel freely.

These armed people in uniforms and wearing badges were operating under the ‘color of law’.

COLOR OF LAW-TITLE 18 USC 242, 245-TITLE 42 USC 1983-FORM

Federal law provides that it is a crime to violate the Rights of a citizen under the color-of-law. You can be arrested for this crime and you can also be held personally liable for civil damages.
Attempting to cause a person to do something by telling that person that such action is required by law, when it is not required by law, may be a felony.
18 USC §242 provides that whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States ... shall be fined under this title or imprisoned not more than one year, or both.
18 USC §245 provided that Whoever, whether or not acting under color of law, intimidates or interferes with any person from participating in or enjoying any benefit, service, privilege, program, facility, or activity provided or administered by the United States; [or] applying for or enjoying employment, or any perquisite thereof, by any agency of the United States; shall be fined under this title, or imprisoned not more than one year, or both.
42 USC §1983 provides that every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress.

I want the officer to be charged with unlawful detainment/kidnapping. There were 2 other officers that allowed this crime to be committed. They need to be charged too. I am now giving you the proof on video that I was kidnapped by 3 armed personnel, supposedly representing the people’s inalienable rights, yet they violated mine on several occasions. It is your duty to uphold the Law and it is obvious that these men need to be charged and arrested. They have violated my rights and I want charges made and the arrests to be immediate. I will sue for damages and the violation of my inalienable rights.

Charges to be brought up against the 3 armed people wearing uniforms and badges. This list is NOT all inclusive of all charges I will be filing. I will most likely find more charges to file against this unlawful detainment/kidnapping.

I will appear in this court, even though I have not committed a crime. I am appearing in court because Judge Huerte ordered me to do so. I am not RANDALL SCOTT BROWN. That flesh and blood individual does not exist. I am Rebel.

The title RANDALL SCOTT BROWN is an unlawful ‘fictitious legal entity’. That is a corporation and is not I. I am a free and peaceful man asserting my rights. Claiming I am RANDALL SCOTT BROWN is fraud. I am a living, breathing, flesh and blood human being. I am not a legal entity. I am not in this courts jurisdiction as I do not consent and I do not relinquish any of my rights.

Use of words
I will be using words that are defined in the dictionaries. Every word I use is in common language and defined by my definition that I choose in the dictionaries. It is not lawful to assume I am using your definition. You must ask for clarification of every word. You may not assume my meaning of words. I am not using legal nonsense of said words that bind me into contract with this government/corporation…. I am not subject to any Law other than the Bill of Rights or codes and statutes that do not violate my rights, which are supposedly protected by the Bill of Rights…. The Bill of Rights is a restraining order against a tyrannical government…. And that is what I am addressing… I refuse to relinquish my rights for any reason. Furthermore, stepping into a courtroom does not constitute my admission to anything. Stepping into a courtroom does not remove any of my rights. I do not ever relinquish my rights.

I do not have a contract with this government/corporation and I do not consent to any courtroom proceedings, except under Common Law or Natural Law. I am not subject to Admiralty law or any other law. I am not in the jurisdiction of this court. I want this case dismissed immediately or I will file charges against this court and every person individually for harassment and threats of violence under the Color of Law….

I will be bringing several people to the court with cameras and phones to record this court interaction. The public needs to see how a peaceful man, that has harmed no person, harmed no property and is peacefully asserting his rights is treated by this court. This harassment of peaceful people asserting their rights has to end.

If you do not reply in writing with a certified receipt to this Affidavit of Truth within 10 business days, your non-response to this Affidavit of Truth is implied consent that I have not committed a crime. A non-reply will make this Affidavit of Truth a LAWFUL document to be used in court. I want both of these charges dismissed immediately and the record cleared.

Interesting argument but nothing is going to happen from that other than his motions and requests will be denied and if he does not appear as scheduled he will be arrested again.  He will then be and held in jail until his next court date and dealt with in the court. 

Like fireworks-- good show but much ado about nothing.  In the end he will lose-- every time!

When I was practicing I saw similar a couple times.  Fun to watch but that was it.

This gentleman is part of the Sovereign Citizen movement. He also has a video of the arresting police officer violating his BOR's specifically the 4A.

When you watch the video the LEO does violate his rights, e.g. does not let him know why he is being stopped, demanding him to get out of his vehicle without telling him why, threatening him with bodily harm and vehicle vandalism, etc. Hence the comment that he has a video.

Rebel's case should be interesting to watch mainly because he has been 100% passive during both vehicle stops and never bad mouthed or resisted the LEO. He is retired and has enough funds to fight this as long as he or the state wants.

Should be fun to follow.
