This is a good example of the workings of English Common Law in practice.
Here is my overly simplistic attempt to explain.
Instead of a Bill Of Rights. English Common Law operates upon the concept that the individual has "all rights" by default. Where those rights conflict with another persons rights. It goes to the courts to decide which persons rights have precedent over the other. This creates a legal precedent that then can be used to decide future conflicting rights issues of the same ilk.
As with any system it is not perfect, yet serves the society here well.
